A complaint brought by five Federal Capital Territory (FCT) citizens attempting to halt President Bola Tinubu’s inauguration has been dismissed by the Federal High Court in Abuja.
Remember the lawsuit filed by five inhabitants of Abuja: Anyaegbunam Okoye, David Adzer, Jeffrey Uche, Osang Paul, and Chibuike Nwanchukwu. They did so on their own behalf as well as on behalf of other residents and FCT electors who had registered to vote.
Plaintiffs claimed that Tinubu fell short of receiving at least 25% of the votes cast in the Federal Capital Territory (FCT) in the lawsuit filed on April 28.
They requested a court injunction barring the Chief Justice of Nigeria (CJN), as well as any other judicial officials, authorities, or individuals, from ordaining any candidates for the February 25 presidential election as president or vice president.
Aside from that, they requested that the court prevent the Chief Justice of Nigeria (CJN) and any other judicial officer from swearing in any presidential candidate as president or vice president of the Federal Republic of Nigeria until the matter was resolved in court. Tinubu had been given a certificate of return.
Chuks Nwachukwu, the plaintiffs’ attorney, also informed the court that the plaintiffs had submitted originating papers and an ex parte application to have the Court of Appeal interpret the constitutional issues.
However, Justice Inyang Ekwo rejected the case on the grounds of lack of jurisdiction and locus standi in her ruling on Tuesday.
He also awarded a cost of N20 million against lawyer Chuks Nwachukwu Esq.
Justice Ekwo further mandated that the Legal Practitioners Disciplinary Committee (LPDC) receive the case file and all submitted legal documents in order to take the proper disciplinary action against the attorney.
The judge ruled that the plaintiffs shouldn’t proceed with the case until the N20 million granted is completely paid.
